The Terms and Conditions of the C Magazine Auction differ from those of our auction host, Waddington’s (onlineauctions.waddingtons.ca). For the C Magazine Auction, a buyer’s premium of 10% will be added to your invoice. No HST or other sales tax is applicable. C Magazine will invoice the buyer at the email they register with at Waddingtons. Buyers are responsible for shipping, C Magazine can provide shipping quotes based on location. Bidders are legally responsible for all bids that they have placed and all sales are final. Please review the full Terms & Conditions.
Terms of Bidding
Bidders must register for a paddle at onlineauctions.waddingtons.ca in order to participate in the auction. The bidder’s email address, as registered with Waddington’s at onlineauctions.waddingtons.ca will be shared with C Magazine for administrative purposes. The email will be used for auction-related communications only.
All sales are final. No purchase can be returned, refunded or exchanged. Bidders are legally responsible for all bids that they have placed, even if a bid has been placed in error.
A buyer`s premium of 10% of the successful bid price of each lot is paid by the buyer as part of the total purchase price. No HST/ sales tax is applicable.
Successful bidders must pay for their purchases by Visa, American Express or Mastercard, online within 48 hours of receiving their invoice, unless otherwise arranged by emailing Kate Monro, the authorized representative of C Magazine at firstname.lastname@example.org.
The Estimate reflects the market value of the piece. The starting bid represents a percentage of the estimate (typically 50%), and is the minimum the piece can be sold for.
A proxy bid is the highest price a bidder is willing to pay for a lot. Your bidding stops when your proxy bid is reached, or the auction closes. Your bid will automatically increase every time someone bids against you by the next bid increment until your proxy bid is reached. The Quick Bid button is a way for you to bid the next bid increment immediately. It is often used in the last minutes of an auction when bidding becomes more aggressive.
Lots are listed in the numeric order by which they will close. Lots begin closing in groups of 25 lots every 10 minutes on the final day of the auction on Tuesday, June 16, 2020 at precisely 8pm EST. For example, lots 1 to 25 may close at 8pm, while lots 26-50 may close at 8:10pm, and so on, until all lots are closed.
If a bid is placed on a lot within the last 5 minutes of bidding on that lot, the lot’s auction end-time will extend 5 minutes from the time the last bid is placed. This will continue until there is no bidding for 5 minutes on each lot.
Bidders will be notified by email when they are outbid, and will also receive an alert if they are on the bidding site at the time they are outbid. The Buyer will also be notified of their purchase by email after the end of the auction (this will take more time to process). In the case of identical bids, the earliest received will take precedence. C Magazine and Waddington’s are not responsible for technical errors or failures to execute bids.
The Buyer will be the highest bidder for the lot and the Buyer immediately assumes full risk and responsibility for the lot. When you register for your bid paddle, you are agreeing to these rules.
Bid increments differ depending on where the price of the piece is at the time of the bid:
Bids under $250 ($10 increments)
$250 to $499 ($25 increments)
$500 to $999 ($50 increments)
$1,000 to $1,999 ($100 increments)
$2,000 to $4,999 ($250 increments)
$5,000 to $9,999 ($500 increments)
All preview catalogue descriptions at auction.cmagazine.com are subject to any variation found in the online auction listing at onlineauctions.waddingtons.ca when the sale opens on Wednesday, June 3, 2020 at 6pm EST. C Magazine reserves the right to withdraw any work of art at any time before the actual sale begins.

Conditions of Sale
By bidding at auction, bidders are bound by the Conditions of Sale and Terms of Bidding, as amended by any announcements, lot descriptions or posted notices, which together form the contract of sale between the successful bidder (buyer), and C Magazine (auctioneer).
Each lot lists an estimated market value obtained from sources C Magazine believes to be reliable. This estimated value is intended as a guide to assist attendees in their bidding. No representation or warranty as to the resale value of a work being auctioned is made or implied.
All artworks are in excellent condition unless otherwise stated. Sizes are approximate. Descriptions or photographs of lots are not warranties and each lot is sold "as is" in accordance with the Conditions of Sale. If the piece is not signed and dated, C Magazine can request a certifcate of authentication from the artist.
Due to current business operating restrictions concerning Covid-19, certain artworks listed as "Framed by Superframe" will not be framed until after they are bid on. For lots listed as unframed, framing is available by Superframe at a sponsorship discount of 35%. In these cases, the suggested framing specifications will be as described, and a quote can be obtained by emailing Kate at email@example.com
Tax Receipts for Art Purchases
For artworks that sell for more than 100% of the estimated value, the Buyer will be issued a charitable tax receipt for the difference between the lowest estimate and the selling price.
Shipping, Delivery, Pick-Up
The Buyer must designate the services of an independent shipper and be responsible for all shipping and insurance expenses. The Auctioneers will undertake packing for delivery and pick-up, but not for shipping of works that require crating. Upon completion of the auction C Magazine will email the Buyer and provide them with shipping, delivery and pick-up options, as applicable to their and the artwork’s location, but will not be held responsible for the service or have any liability for providing this information. FedEX and Canada Post will be quoted by C Magazine, with any applicable limits on liability and insurance. Declared value or added insurance is at the Buyer’s discretion.
In certain cases, Covid-19 restrictions have meant that an artwork is in a location outside of Toronto, and shipping will need to be arranged accordingly. The location of each artwork will be noted within the lot description. Reliable pre-auction estimates of long-distance shipping costs of lots offered in this sale may be obtained from:

In accordance with and due to the Ontario Government's guidelines concerning Covid-19, we are currently not able to arrange immediate shipping, delivery or pickup for every purchase. We will store purchases free of charge at an insured, secured location if these restrictions have not been lifted by the auction closing date of Tuesday, June 16, 2020. Once restrictions have lifted shipping, delivery or pick-up arrangements must be made within one week.
